About Excalibur's Arbitration Services

Excalibur provides effective, thoroughly professional arbitration services to clients off-site in the Cornwall, Smiths Falls, Brockville, Belleville, Perth, Port Hope and Peterborough areas as well as on-site at our Resource Centre in Kingston, Ontario. Arbitration is one form of Alternative Dispute Resolution (ADR)

In the arbitration process a neutral, impartial third party (the arbitrator) is appointed and reviews the evidence and arguments presented by the parties involved in a dispute. The arbitrator then arrives at a decision as to how the dispute will be brought to closure.

Arbitration proceedings can either be binding or non-binding. If a settlement is to be binding, the parties are required (prior to the start of arbitration) to waive any right to contest the arbitrator's decision in court. In the case of non-binding arbitration, the arbitrator's ruling may be contested. This ability to proceed with litigation if either party does not accept the arbitrator's ruling, however, tends to negate the potential benefits of arbitration (less costly and faster than court proceedings).

Excalibur provides a team of arbitration specialists, which includes the arbitrator. Excalibur's team is responsible for gathering and organizing documents to be presented as evidence, verifying the terms of the arbitration (binding or non-binding). The arbitrator then convenes the arbitration session(s) to hear the arguments from the disputants after which he/she will render a decision as to how the conflict is to be resolved. Our organization is a member of the ADR Institute of Ontario and the ADR Institute of Canada and adheres to the professional standards set by both institutes with regards to arbitrators and arbitration proceedings.

Although our arbitration services are available off-site in the areas of Cornwall, Smiths Falls, Brockville, Belleville, Perth, Port Hope and Peterborough, we encourage parties to convene at Excalibur's Resource Centre in Kingston. Our Kingston Resource Centre is a facility specifically designed to provide ADR services with comfortable, quiet spaces for parties to engage in either one large-group session or, if/when appropriate, several separate small-group sessions. Excalibur can provide our clients with a comfortable meeting environment free of distractions and with an experienced, effective team of arbitration specialists whose expertise has been matched to the specific nature of the conflict requiring closure.
